Conditions of participation for all HAIX Group Competitions on Facebook & Instagram
1. Preamble:
These conditions of participation regulate the participation in competitions of HAIX Schuhe Produktions- und Vertriebs GmbH, Auhofstraße 10, 84048 Mainburg, Germany (hereinafter referred to as “HAIX”) on www.facebook.com/haixglobal (hereinafter referred to as “Facebook appearance”) as well as on www.instagram.com/haixdeutschland (hereinafter referred to as “Instagram appearance”) by participants as well as the collection and use of data collected or communicated by participants.
2. Eligibility:
(1) All campaigns are open only to those who are 18 years of age or older as of the date of entry.
(2) Employees of HAIX Schuhe Produktions- und Vertriebs GmbH (“HAIX”), its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign.
(3) The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
(4) No Purchase is necessary, a purchase does not enhance chance of winning
3. Agreement to Rules
By entering the respective competition, participants accept these terms and conditions.
4. Campaign Period
The respective competition begins with the publication of the competition entry on the Facebook or Instagram site and ends with the expiry of the end date stated there.
5. How to Enter
(1) The terms and conditions of the respective competition, the contributions to be made by the participants and other requirements for participation result from the respective competition entry on the Facebook or Instagram site.
(2) The entry must fulfill all Campaign requirements, as specified, to be eligible to win a prize.
(3) Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of HAIX.
(4) If fraudulent methods are used or otherwise circumventing the rules is attempted, the submission may be removed from eligibility at the sole discretion of HAIX.
(5) If the respective competition requires the participants to provide content (e.g. pictures) as a contribution to the competition, the organiser is not obliged to check the content provided for potential violations of the rights of third parties. However, the organizer is entitled to reject content if, in his reasonable opinion, it is illegal or contra bonos mores.
(6) If participants upload content within the scope of the respective competition, in particular pictures, the participants declare that the content is free of rights of third parties, i.e. that it either originates from them or that they have obtained the consent of the authors as well as the persons depicted in the pictures and videos.
6. Prize:
(1) Prizes will be raffled among the participants of the respective raffle.
(2) The prizes and the conditions under which they are raffled off are described in more detail by the organiser in the respective competition entry. If not described in more detail, the lottery decides.
(3) No cash withdrawal of prizes.
7. Winner Selection and Notification
(1) Winner will be selected by drawing of lots Winner will be notified by E-Mail or Facebook/Instagram private Message within 5 days following selection of Winner.
(2) HAIX shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information.
(3) If Winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected.
(4) Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. Publication of Submissions
(1) The participants agree that submissions in connection with the respective competition, the draw, the handling and presentation of the entries may be used, distributed and made publicly accessible to third parties in any other way by the organizer in online and offline media (for example in print).
(2) For these purposes, the organizer is also permitted to process the submissions and, if necessary, to grant rights of use to third parties. This granting of rights is free of charge and without any restrictions in terms of space, content or time.
9. Terms & Conditions:
(1) HAIX reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond HAIX’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign.
(2) In such case, HAIX may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by HAIX.
(3) HAIX reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions.
(4) HAIX has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering.
(5) Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws.
(6) Should such attempt be made, HAIX reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability
By entering, participants agree to release and hold harmless HAIX and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
11. Further provisions
(1) This competition is not linked to Facebook or Instagram in any way.
(2) All personal data will remain confidential and will not be shared with third parties.
(3) All inquiries and notices regarding the particular contest should be directed to the Promoter and not to Facebook or Instagram.
12. Miscellaneous
(1) Legal recourse is excluded.
(2) These Conditions of Participation and the entire legal relationship between the participants and HAIX-Schuhe Produktions- und Vertriebs GmbH are governed exclusively by the law of the Federal Republic of Germany.
(3) Should individual provisions of the Conditions of Participation be or become invalid, the validity of the remaining Conditions of Participation shall remain unaffected.
(4) These Conditions of Participation can be amended at any time by HAIX-Schuhe Produktions- und Vertriebs GmbH without prior notice.
